Por favor contacte-nos em info@cocreate.pt se tiver d\u00favidas em rela\u00e7\u00e3o a este TDU.<strong>&nbsp;<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Aceita\u00e7\u00e3o dos Termos.&nbsp;<\/strong><\/li><\/ol>\n\n\n\n<p>The services CoCreate provides to you, the undersigned (including but not limited to use of office space and access to Internet), are subject to the following Terms of Use (\u201cTOU\u201d).&nbsp;<\/p>\n\n\n\n<p>CoCreate reserves the right to update the TOU at any time. CoCreate will attempt to contact you to notify you of any updates within 30 days of their enactment using the contact information provided in the Membership Agreement.&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\" start=\"2\"><li><strong>Descri\u00e7\u00e3o dos Servi\u00e7os.&nbsp;<\/strong><\/li><\/ol>\n\n\n\n<p>CoCreate may provide you with access to office space, work stations, Internet access, office equipment, conference space, knowledge resources, and other services as CoCreate may provide from time to time (collectively, \u201cServices\u201d). The Services at all times are subject to the TOU.&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\" start=\"3\"><li><strong>Nenhum Uso Ilegal ou Proibido.&nbsp;<\/strong><\/li><\/ol>\n\n\n\n<p>As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair any CoCreate server, or the network(s) connected to any CoCreate server, or interfere with any other party\u2019s use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, or accounts, computer systems or networks connected to any CoCreate server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.&nbsp;<\/p>\n\n\n\n<p>Voc\u00ea aqui declara e garante que tem todo o poder e autoridade legal necess\u00e1rios para entrar e respeitar os termos e condi\u00e7\u00f5es deste TDU e n\u00e3o \u00e9 necess\u00e1ria qualquer outra autoriza\u00e7\u00e3o ou aprova\u00e7\u00e3o. Voc\u00ea declara e garante ainda que sua participa\u00e7\u00e3o ou uso dos Servi\u00e7os n\u00e3o entrar\u00e1 em conflito com ou resultar\u00e1 em qualquer viola\u00e7\u00e3o de qualquer licen\u00e7a, contrato, acordo ou outro instrumento ou obriga\u00e7\u00e3o da qual voc\u00ea seja parte.&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\" start=\"4\"><li><strong>Utiliza\u00e7\u00e3o de servi\u00e7os.&nbsp;<\/strong><\/li><\/ol>\n\n\n\n<p>Voc\u00ea concorda que ao participar ou usar os Servi\u00e7os, voc\u00ea n\u00e3o o far\u00e1:&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Use os Servi\u00e7os em conex\u00e3o com concursos, esquemas em pir\u00e2mide, cartas em cadeia, lixo eletr\u00f4nico, spamming ou qualquer mensagem duplicada ou n\u00e3o-solicitada (comercial ou n\u00e3o);&nbsp;<\/li><li>Difamar, abusar, assediar, perseguir, amea\u00e7ar ou violar os direitos legais (tais como direitos de privacidade e publicidade) de terceiros;&nbsp;<\/li><li>Publicar, postar, carregar, distribuir ou divulgar qualquer t\u00f3pico, nome, material ou informa\u00e7\u00e3o inapropriada, profana, difamat\u00f3ria, obscena, indecente ou ilegal, sobre ou atrav\u00e9s de C o Criar Servi\u00e7os;&nbsp;<\/li><li>Carregar, ou disponibilizar de outra forma, arquivos que contenham imagens, fotografias, software ou outro material protegido por leis de propriedade intelectual, incluindo, a t\u00edtulo de exemplo, e n\u00e3o como limita\u00e7\u00e3o, leis de direitos autorais ou de marcas registradas (ou por direitos de privacidade ou publicidade), a menos que voc\u00ea seja propriet\u00e1rio ou controle os direitos ou tenha recebido todo o consentimento necess\u00e1rio para fazer o mesmo;&nbsp;<\/li><li>Utilizar qualquer material ou informa\u00e7\u00e3o, incluindo imagens ou fotografias, que sejam disponibilizados atrav\u00e9s dos Servi\u00e7os de qualquer forma que infrinja qualquer direito de autor, marca registada, patente, segredo comercial, ou outro direito de propriedade de qualquer parte;&nbsp;<\/li><li>Upload de arquivos que contenham v\u00edrus, cavalos de Tr\u00f3ia, worms, bombas-rel\u00f3gio, cancelbots, arquivos corrompidos ou qualquer outro software ou programa similar que possa danificar o funcionamento do computador de outro ou propriedade de outro;&nbsp;<\/li><li>Baixe qualquer arquivo(s) que voc\u00ea saiba, ou que razoavelmente deveria saber, n\u00e3o pode ser legalmente reproduzido, exibido, executado e\/ou distribu\u00eddo de tal forma;&nbsp;<\/li><li>Restringir ou inibir qualquer outro usu\u00e1rio de usar e desfrutar dos Servi\u00e7os;&nbsp;&nbsp;<\/li><li>Colher ou recolher informa\u00e7\u00f5es sobre outros, incluindo endere\u00e7os de e-mail, sem a autoriza\u00e7\u00e3o ou consentimento da parte reveladora;&nbsp;<\/li><li>Violar quaisquer leis ou regulamentos aplic\u00e1veis; e&nbsp;<\/li><li>Criar uma identidade falsa com o prop\u00f3sito de enganar os outros.&nbsp;<\/li><\/ol>\n\n\n\n<p><strong>5. CoCreate reserves the right at all times to disclose any information about you, <\/strong>seu<strong> <\/strong>participation in and use of the Services as CoCreate deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in CoCreates sole discretion.&nbsp;<\/p>\n\n\n\n<p><strong>6. Confidencialidade.&nbsp;<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>You acknowledge and agree that during your participation in and use of the Services you may be exposed to Confidential Information. \u201cConfidential Information\u201d shall mean all information, in whole or in part, that is disclosed by CoCreate, or any participant or user of the Services or any employee, affiliate, or agent thereof, that is nonpublic, confidential or proprietary in nature. \u2028<\/li><\/ol>\n\n\n\n<p>Confidential Information also includes, without limitation, information about business, sales, operations, know-how, trade secrets, technology, products, employees, customers, marketing plans, financial information, services, business affairs, any knowledge gained through examination or observation of or access to the facilities, computer systems and\/or books and records of CoCreate any analyses, compilations, studies or other documents prepared by CoCreate or otherwise derived in any manner from the Confidential Information and any information that you are obligated to keep confidential or know or has reason to know should be treated as confidential.&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\" start=\"2\"><li>A sua participa\u00e7\u00e3o e\/ou utiliza\u00e7\u00e3o dos Servi\u00e7os obriga-o a&nbsp;<\/li><\/ol>\n\n\n\n<ol class=\"wp-block-list\"><li>manter toda a Informa\u00e7\u00e3o Confidencial em estrita confidencialidade;&nbsp;<\/li><li>n\u00e3o divulgar Informa\u00e7\u00f5es Confidenciais a terceiros;&nbsp;<\/li><li>not to use the Confidential Information in any way directly or indirectly detrimental to CoCreate, or any participant or user of the Services.&nbsp;<\/li><\/ol>\n\n\n\n<p>c) All Confidential Information remains the sole and exclusive property of CoCreate or the respective disclosing party. You acknowledge and agree that nothing in this TOU or your participation or use of the Services will be construed as granting any rights to you, by license or otherwise, in or to any Confidential Information or any patent, copyright or other intellectual property or proprietary rights of CoCreate, or any participant or user of the Services.&nbsp;<\/p>\n\n\n\n<p><strong>7. Participa\u00e7\u00e3o em ou Utiliza\u00e7\u00e3o de Servi\u00e7os.&nbsp;<\/strong><\/p>\n\n\n\n<p>You acknowledge that you are participating in or using the Services at your own free will and decision. You acknowledge that CoCreate does not have any liability with respect to your access, participation in, use of the Services, or any loss of information or equipment resulting from such participation or use.\u00a0<\/p>\n\n\n\n<p>You may not attempt to gain unauthorized access to any Services, or accounts, computer systems or networks connected to any CoCreate server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.<\/p>\n\n\n\n<p>If you are the last person to leave, turn off the lights and make sure the coffee maker are off; close all windows, and lock the door.<\/p>\n\n\n\n<p><strong>8. Exonera\u00e7\u00e3o de Garantias.&nbsp;<\/strong><\/p>\n\n\n\n<p>To the maximum extent permitted by applicable law, CoCreate provides the services \u201cas is\u201d and with all faults, and hereby disclaim with respect to the services all warranties and conditions, whether express, implied or statutory, including, but not limited to, any (if any) warranties, duties or conditions of or related to: merchantability, fitness for a particular purpose, lack of viruses, accuracy or completeness of responses, results, workmanlike effort and lack of negligence. Also, there is no warranty, duty or condition of title, quiet enjoyment, quiet possession, correspondence to description or non-infringement. The entire risk as to the quality, or arising out of participation in or the use of the services, remains with you.&nbsp;<\/p>\n\n\n\n<p><strong>9. Exclus\u00e3o de Danos Incidentais, Consequenciais e Alguns Outros.&nbsp;<\/strong><\/p>\n\n\n\n<p>As a user, it is strongly suggested that you carry a Renters Insurance policy to cover your own equipment while using our space. That policy may cover your current residence\/office, as well as the premises of CoCreate.<\/p>\n\n\n\n<p>To the maximum extent permitted by applicable law, in no event shall CoCreate or its subsidiaries (whether or not wholly-owned), affiliates, divisions, and their past, present and future officers, agents, shareholders, members, representatives, employees, successors and assigns, jointly or individually be liable for any direct, special, incidental, indirect, punitive, consequential or other damages whatsoever (including, but not limited to, damages for: loss of profits, loss of confidential or other information, business interruption, personal injury, loss of privacy, failure to meet any duty (including of good faith or of reasonable care), negligence, and any other pecuniary or other loss whatsoever) arising out of or in any way related to the participation in or inability to participate in or use of the services, the provision of or failure to provide services, or otherwise under or in connection with any provision of this agreement, even in the event of the fault, tort (including negligence), strict liability, breach of contract or breach of warranty of CoCreate, and even if CoCreate has been advised of the possibility of such damages.&nbsp;<\/p>\n\n\n\n<p><strong>10. 10. Limita\u00e7\u00e3o de Responsabilidade e Rem\u00e9dios.&nbsp;<\/strong><\/p>\n\n\n\n<p>Notwithstanding any damages that you might incur for any reason whatsoever (including, without limitation, all damages referenced above and all direct or general damages), the entire liability of CoCreate or its subsidiaries (whether or not wholly-owned), affiliates, divisions, and their past, present and future officers, agents, shareholders, members, representatives, employees, successors and assigns under any provision of this TOU and your exclusive remedy for all of the foregoing shall be limited to actual damages incurred by you based on reasonable reliance up to ten Euros (EUR 10.00). The foregoing limitations, exclusions and disclaimers (including sections 8 and 9 above) shall apply to the maximum extent permitted by applicable law, even if any remedy fails its essential purpose.&nbsp;<\/p>\n\n\n\n<p><strong>11. Rescis\u00e3o.&nbsp;<\/strong><\/p>\n\n\n\n<p>CoCreate reserves the right to terminate any Service at any time. CoCreate further reserves the right to terminate your participation in and use of any Services, immediately and without notice, if you fail to comply with the TOU and\/or are disruptive to the work environment for others.&nbsp;<\/p>\n\n\n\n<p><strong>12. Indemniza\u00e7\u00e3o.&nbsp;<\/strong><\/p>\n\n\n\n<p>You release, and hereby agree to indemnify, defend and save harmless CoCreate and CoCreate\u2019s subsidiaries (whether or not wholly-owned), affiliates, divisions, and their past, present and future officers, agents, shareholders, members, representatives, employees, successors and assigns, jointly and individually, from and against all claims, liabilities, losses, damages, costs, expenses, judgments, fines and penalties based upon or arising out of your negligent actions, errors and omissions, willful misconduct and fraud in connection with the participation in or use of the Services. You further agree in the event that you bring a claim or lawsuit in violation of this agreement, you shall be liable for any attorneys\u2019 fees and costs incurred by CoCreate or its respective officers and agents in connection with the defence of such claim or lawsuit.&nbsp;<\/p>\n\n\n\n<p><strong>13. Severabilidade.&nbsp;<\/strong><\/p>\n\n\n\n<p>No caso de qualquer disposi\u00e7\u00e3o ou parte deste TDU ser considerada inv\u00e1lida, ilegal ou inaplic\u00e1vel por qualquer raz\u00e3o, no todo ou em parte, as restantes disposi\u00e7\u00f5es deste TDU n\u00e3o ser\u00e3o afectadas por isso e permanecer\u00e3o em pleno vigor e efeito at\u00e9 ao limite m\u00e1ximo permitido pela lei aplic\u00e1vel.&nbsp;<\/p>\n\n\n\n<p><strong>Reconhe\u00e7o que li e compreendi todos os termos e condi\u00e7\u00f5es contidos neste TDU e concordo ainda em ficar vinculado ao TDU em rela\u00e7\u00e3o \u00e0 minha participa\u00e7\u00e3o e utiliza\u00e7\u00e3o dos Servi\u00e7os.&nbsp;<\/strong><\/p>","protected":false},"excerpt":{"rendered":"<p>CoCreate offers a shared, community-driven workspace for creative, location-independent workers.
